MembershipAgreement & Liability Waiver
The Member hereby agrees to abide by all posted safety guidelines and regulations while using JDI Barbell facilities and equipment. The Member attests that they are fully able to participate in an exercise regimen of their design or choosing without undue risk. The Member further attests that he/she has executed the JDI Barbell waiver before entering the JDI Barbell premises.
JDI Barbell is committed to the health, safety, and welfare of each of its members and staff and will not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behavior. The Member understands that no smoking is allowed in any part of the facility.
JDI Barbell has the sole right to judge this and any other behavior and respond accordingly. Failure to abide by any of these rules may result in termination of the Member's membership without refund.
JDI Barbell reserves the right to add, change or remove rules, conditions of membership, opening and closing hours, and all services and facilities offered by JDI Barbell.
JDI Barbell assumes no responsibility for damaged, lost, or stolen articles. Lost and found articles not claimed after 30 days will be donated to charity or thrown away.
There are no membership holds. All subscriptions at JDI Barbell are either annual or month-to-month and self-service. After a monthly payment has been processed, NO refunds will be issued for payments that have been processed, and no credits will be given for unused time.
A Member may cancel their membership at any time using the JDI Barbell app. Through the app, a member can cancel their membership up until the day before their next charge. It is the member's responsibility to cancel their membership prior to their charge date in order to avoid being charged for the subsequent month. Please remember partial months are not permitted; there are no refunds for membership fees; and JDI Barbell will not prorate a cancelled membership.
Membership access is for the Member only. Allowing anyone else access to the facility using the Member's access, key fob, code, or membership privileges is strictly prohibited. Any violation of this policy may result in membership termination and/or a $65 fee per unauthorized entry. Guest access is only allowed through an approved guest pass in accordance with JDI Barbell policies.
Members shall pay for any damages to JDI Barbell property which results from the willful or negligent conduct of the Member.
The Member agrees that the Member must consult his or her physician for any medical advice and the Member is ultimately responsible for his or her health and safety. The Member hereby accepts all health risks, including injury or death, that may result from such participation and releases JDI Barbell, on the Member's behalf and on behalf of the Member's personal representatives, estate, heirs, next of kin, and assigns from any and all costs, claims, causes of action and damages arising from any and all illness or injury to the Member's person, including the Member's death, that may result from or occur as a result of working out at JDI Barbell or participation in a JDI Barbell program.
This Agreement (and the aforementioned waiver) contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this Agreement. The provisions of this may be waived, altered, amended or repealed, in whole or in part, only upon prior written consent of all parties.
The Member has read, and fully agrees to the terms of this Agreement and understands and agrees that by signing this Agreement (which includes a waiver, release and assumption of risks), the Member has given up considerable future legal rights. The Member has signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to him/her.
The Member certifies and warrants that he/she is 18 years of age or older and mentally competent to enter into this Agreement.
If any portion of this agreement is deemed illegal, void or unenforceable, then the remaining agreement shall remain in effect.
